Product Liability

Many questions arise around the effect of a product on groups of individuals:

   o  How does the use of a product affect a group or subgroup of individuals?

   o  Does its use cause immediate harm, like adverse effects from a pharmaceutical product or improper design of a part on an automobile?

   o  Does the product itself lead to harm over time, like asbestos with a long latency period?

   o  What loss is suffered if the product fails or causes harm?

We examine whether there is an indication that a product is widely harmful.  There is the biometric risk of an impact on an individual or group of people, and the likelihood and potential economic loss if a product is found to be harmful. We also help in examining insurance issues, such as allocation between insurers, product versus nonproduct liability, and determining the possible risk for an insurer when a class of persons harmed might file suit.
