Environmental Tort/Toxic Tort

Our expert witnesses provide expert testimony for issues related to exposure to a hazard affect many parties. Risk managers in the firm with an inadvertent contamination, insurers, outside legal counsel, investors, state health officials, and particularly those affected by exposure to a hazard want to know not just where the hazard was found but also the number of persons, properties, and businesses affected over time. Are there a substantial number of persons exposed over time? Are property values in an area near the site up or down relative to similar areas in the same county? Is the rate at which property sales occurring near the site slower or faster than expected given the types of properties? Are commercial sales depressed because of the threat of the cost or importunity of remediation? All of these questions rely on knowing the impact of contamination on the population, which in turn requires knowing what population is, in fact, affected by proximity to such a site.

Case Examples:

A chemical plant had a release of toxic materials in an explosion. For properties in a fixed radius around the plant, there were no claims of health issues, but stigma was alleged for the properties. We examined property values for all properties in the radius around the plant, in neighborhoods outside the radius but touching the class area, and in the balance of the county. Tests developed to determine whether properties in class area had lost value relative to properties outside of the class area. Tests demonstrated that property values had diminished in the county in neighborhoods near other industrial sites, but not the site where class was filed. Class certification defeated.

A fertilizer manufacturer had over time caused contamination to groundwater because of leaching of chemicals in run-off that went into drains. Both health claims and property value diminution was claimed. We developed search method to find any areas where property values in the county were lower than predicted and correlated these with groundwater flows and industrial production sites. No evidence of loss attributable to manufacturer was demonstrable for the time the contamination occurred, for the time that the contamination became known, nor the time that the contamination was publicized during the trial. Class certification defeated.
