Claims & Damages Forecasting

We both estimate damages and evaluate opposing claims of damages in cases involving product liability and intellectual property. We have experience with forecasting in complex cases dealing with injuries that occur over long periods of time to populations that are mobile and aging. Using rigorous demographic and biometric techniques, we provide our clients with estimates of the sizes of exposed populations, extent of exposure, and likelihood of claims.



Case Examples:

Asbestos, in class actions and bankruptcies, forecasting the number of persons who would develop mesothelioma, lung cancer, or some type of pleural impairment. Forecast the proportion who would file in one or more class actions, and the likely award to each type of claimant. Results used in allocation of awards to current versus future claimants.

Lead paint, in response to a class action filed against producers of lead paint. Developed methods for determining number of housing units that had lead paint used at some time, potential cost of remediation, and likely time frames for filing of cases by future class members. Results used to develop settlement strategy.
